What Is Progressive Discipline?

The Code of Good Practice, contained in Schedule 8 of the Labour Relations Act, is a legislative guideline on the best practices to follow regarding labour procedures. The Code specifically stipulates that any disciplinary action, especially when considering dismissal, should be substantively and procedurally fair.

To achieve this, progressive discipline must be applied. Progressive discipline is a reasonable measure employers must impose on employees who commit misconduct. Its main objective is to improve the employees’ behaviour through the systematic use of warnings and corrective action.  Employees must know and understand what standards are expected from them, and should they not comply, the employer may gradually discipline them.

Progressive disciplinary steps usually range from verbal to written and ultimately to final written warnings. Still, employers should note that not all types of misconduct need to be met in the same chronological order. The type of warning issued may depend on the severity of the transgression and the merits specific to the circumstances.

If this is an area that you, as an employer, particularly struggle with, be rest assured that SEESA Labour has got you covered.  Our Disciplinary Code is a convenient guideline drafted in such a manner that it outlines the most common transgressions in the workplace and the appropriate steps you should take to comply with the practice of progressive discipline.
